TCPA compliance for lead generation
TCPA compliance for lead generation means collecting and recording consumer consent so buyers can lawfully call and text the leads they buy. Autodialed or prerecorded marketing calls and texts need prior express written consent that clearly authorizes the seller to call the number given. Compliance also covers Do Not Call scrubbing, calling hours, opt-outs and state laws.

One-to-one consent: what changed in 2025
The FCC adopted a one-to-one consent rule in December 2023 that would have limited prior express written consent to one seller at a time, and only to calls related to the interaction that prompted the consent. It never took effect. On January 24, 2025 the Eleventh Circuit vacated it in Insurance Marketing Coalition v. FCC, and the FCC removed it from its rules and restored the prior text of 47 CFR 64.1200(f)(9), effective August 29, 2025.
Federal rules today have no one-seller limit on selling a lead to more than one buyer by ping/post. Each seller that calls still needs prior express written consent that clearly authorizes that seller to call, some buyers still require seller-specific consent by contract, and state laws may set their own rules. See what happened to the TCPA one-to-one consent rule.

Our commitment to compliance
Summit Leads takes TCPA (Telephone Consumer Protection Act) and consumer-consent compliance seriously. As a lead generation and distribution company, we recognize that compliance with federal and state telemarketing laws is critical to protecting consumers, maintaining trust with buyers and suppliers, and operating a sustainable business. This page outlines our compliance expectations, the responsibilities of our partners, and how we approach consent and data quality in our lead distribution network.
What we expect from suppliers
All lead suppliers, publishers, and marketing partners who provide leads to Summit Leads must meet the following compliance standards:
Proper, Documented Consumer Consent: Leads must be generated with clear, documented consumer consent. Consumers must have opted in to receive contact from service providers, and the opt-in must be knowing, voluntary, and unambiguous. Consent language must be clear and conspicuous, and consumers must understand that by submitting their information, they are requesting contact and agreeing to be reached by phone, text message, or email.
TCPA-Compliant Consent Mechanisms: Consent must comply with TCPA requirements, including prior express written consent for automated or prerecorded calls to cell phones where required. Consent checkboxes, opt-in language, and disclosure statements must meet federal and state legal standards. Suppliers must maintain records of consumer consent, including form language, IP addresses, timestamps, and opt-in method.
Lawful Sourcing: Leads must be lawfully obtained through legitimate marketing channels. Suppliers may not provide leads that were scraped from websites without consent, purchased from third-party data brokers without proper consent verification, obtained through deceptive or misleading offers, or collected in violation of TCPA, state privacy laws, or other regulations.
Accurate Representation: Suppliers must accurately represent their lead generation methods, traffic sources, and consent practices. Misrepresenting lead quality, consent status, or sourcing methods is grounds for immediate termination and may result in liability for non-compliant leads.
What buyers should know
Buyers who purchase leads from Summit Leads are responsible for their own compliance practices when contacting consumers. While we provide leads that are represented as consented and TCPA-compliant, buyers must conduct independent consent verification, follow TCPA calling-time rules, honor Do Not Call requests, and maintain their own compliance records.
Summit Leads does not control or monitor how buyers contact consumers after purchasing leads. Buyers assume full responsibility for their own contact practices and compliance with TCPA, TSR, state telemarketing laws, and other applicable regulations.
