Massachusetts claims start with the $2,000 line. The District Court model jury instruction on motor vehicle damages (revised May 2024) tells jurors that, unless the injuries include loss of a body member, permanent and serious disfigurement, or loss of sight or hearing, the plaintiff must incur more than $2,000 in medical, hospital and nursing expenses to claim pain and suffering.

Below that line, personal injury protection carries the loss. The Division of Insurance (as of October 7, 2026) describes PIP as covering medical expenses, up to 75% of lost wages and replacement services, up to a limit of $8,000, whoever caused the accident.

Timing matters inside PIP too. G.L. c.90, section 34M (Trial Court Law Libraries text, amended effective February 24, 2026) requires a PIP claim to be presented as soon as practicable and in every case within two years from the date of the accident.

Three years to sue and the 50 percent rule

The tort deadline is three years. The Trial Court Law Libraries guide (as of October 7, 2026) lists G.L. c.260, section 2A, torts and personal injury, at 3 years.

Comparative negligence comes from G.L. c.231, section 85. The District Court comparative negligence instruction (revised May 2024) gives an optional charge: a plaintiff found more than 50% comparatively negligent recovers nothing, and a plaintiff at 50% or less has damages reduced by that percentage. Where more than one defendant is sued, the plaintiff's negligence is compared with the total negligence of all of them combined.

Compulsory coverage after July 1, 2025

Chapter 275 of the Acts of 2024 raised the compulsory limits. The Division of Insurance's Filing Guidance Notice 2025-A (January 29, 2025) sets them, for policies written or renewing on or after July 1, 2025, at $25,000 per person and $50,000 per accident for bodily injury to others, the same for bodily injury caused by an uninsured auto, and $30,000 per accident for property damage. PIP stays at $8,000 per person.

The Division of Insurance (as of October 7, 2026) adds a detail that affects passenger claims: compulsory bodily injury coverage applies only to accidents in Massachusetts and does not cover a passenger in the insured's own car.
