Liability insurance and uninsured motorist coverage in Rhode Island

A Rhode Island injury claim against another driver is paid from that driver's liability policy, which covers the liability imposed by law for damages because of bodily injury, in the words of section 3.10 of the Department of Business Regulation's rating regulation, 230-RICR-20-05-3 (effective January 4, 2022).
The claimant's own policy can matter too. Under 230-RICR-20-05-1 (effective January 4, 2022), no auto policy may be issued in Rhode Island without uninsured and underinsured motorist bodily injury coverage unless the insured rejects it as the regulation provides. The insurer must offer uninsured motorist limits equal to the policy's bodily injury liability limits, and must offer uninsured motorist property damage in a minimum amount of $25,000.
For a Rhode Island lead, that means two insurance questions: who insures the other driver, and whether the claimant kept uninsured or underinsured coverage.
Rhode Island's three-year filing period
In Roe v. Gelineau (2002), the Rhode Island Supreme Court quotes section 9-1-14(b): actions for injuries to the person shall be commenced and sued within three years next after the cause of action shall accrue, and not after. The court also notes that the period can be tolled for the legal disabilities listed in section 9-1-19.
Buyers use the accident date to keep a margin inside those three years, so that a firm has time to collect records and negotiate. Fault answers (how the crash happened, who was cited) go next to the date on the lead, because the claim is made against the driver whose liability policy pays.
The 25/50/25 minimum in Rhode Island
Section 3.10 of 230-RICR-20-05-3 (effective January 4, 2022) sets the minimum liability coverage limits: $25,000 for bodily injury to or death of one person in any one accident, $50,000 for two or more persons in one accident, and $25,000 for injury to or destruction of property of others, or a $75,000 combined single limit.
A claim with serious injuries can reach past a minimum policy, which is why some firms ask the form to record any uninsured or underinsured coverage the claimant holds.

Article V of the Rhode Island Supreme Court Rules holds the Rules of Professional Conduct (revised October 2023). Rhode Island adds filing duties that the ABA Model Rules do not have:
- Rule 7.2, Advertising. Paragraph (b) requires a copy of each print advertisement and a recording of each radio or television advertisement to be sent to the Supreme Court Disciplinary Counsel within 48 hours of first dissemination, and copies to be kept for three years. Paragraph (c) covers giving anything of value for recommending a lawyer's services.
- Rule 7.3, Direct contact with prospective clients. Paragraph (c) requires the words "Advertising Material" on written, recorded or electronic solicitations to a person known to need legal services in a particular matter, and paragraph (d) requires a copy of each such communication to go to Disciplinary Counsel.
