Nebraska has no personal injury protection layer to clear before a claim. An injured person looks to the driver who caused the crash and that driver's liability policy. The Nebraska Department of Insurance (as of October 7, 2026) describes bodily injury liability as coverage that pays medical expenses, lost wages and other costs of injuries sustained by other people.

The same Department page lists uninsured and underinsured motorist coverage among the coverages Nebraska law requires. That coverage pays the policyholder's own injury costs when the driver at fault has too little insurance.
