The Division of Insurance auto page (as of October 2026) describes bodily injury liability as coverage against a claim by someone injured in an accident for which the policyholder is liable. For a lead, liability is therefore the first question.
Uninsured motorist coverage is the second piece. Under SDCL 58-11-9 (2026), no bodily injury liability policy may be issued for a vehicle registered or principally garaged in South Dakota unless it includes uninsured and hit-and-run motorist coverage in limits equal to its bodily injury coverage; the required amount stops at $100,000 per person and $300,000 per accident unless the insured asks for more. The Division of Insurance page puts it more simply: uninsured motorist coverage is required for all policies. That makes the other driver's insurance status, and the claimant's own policy, two early questions on a South Dakota lead.
The slight negligence test and the three-year window
South Dakota uses a comparative rule that names no percentage. Under SDCL 20-9-2 (2026), contributory negligence "does not bar a recovery when the contributory negligence of the plaintiff was slight in comparison with the negligence of the defendant," and damages are then reduced in proportion. The statute also directs that the slight-or-not question be decided without disclosing a percentage of the plaintiff's fault by special interrogatory.
Timing is set by SDCL 15-2-14 (2026), which lists an action for personal injury among the actions that can be commenced only within three years after the cause of action accrues.
