South Dakota storm roofing contract law
This section is general information, not legal advice. It summarizes official sources as of October 7, 2026; check the current text of each rule before relying on it.
South Dakota counts the cancel window in hours. Codified Law 37-24-51 (enacted 2012) lets a person who signs a written storm damage repair contract for residential roofing cancel within seventy-two hours after signing. A second seventy-two-hour window opens when the homeowner is notified that the property insurer has denied the claim in whole or in part. Before signing, the contractor must give a boldface statement of that right and attach a detachable "Notice of Cancellation" form in duplicateDuplicateA lead for a consumer the buyer has already received within a set lookback period, from the same source or another one. Glossary.
Payments for goods and services not yet performed go back to the homeowner within ten days of a cancellation. A cancelling homeowner still owes a documented restocking fee charged by the materials supplierSupplierAny company that provides leads to a buyer, whether it generates them itself or brokers them from publishers. Glossary and the cost of any emergency repairs already done. Under Codified Law 37-24-50, a residential roofing contractor may not advertise or promise to pay or rebate any part of a deductible, and a contract that breaks that rule is void. Section 37-24-49 applies both sections to residential builders and remodelers providing roofing services as well as to residential roofers.

South Dakota hail counts and storm declarations
South Dakota ranked tenth among the 50 states for hail in the NOAA NCEI Storm Events file for 2025, with 329 records of event type Hail. Each row gives the county or forecast zone and the date.
FEMA's Disaster Declarations Summaries show two South Dakota major disasters in this category declared from January 1, 2023 to October 7, 2026: DR-4807 on August 15, 2024 for severe storms, straight-line winds and flooding, and DR-4938 on September 1, 2026 for severe storms, straight-line winds, tornadoes and flooding.
How these were counted: hail is the number of 2025 rows for South Dakota with event type Hail, one row per affected county or zone per storm. FEMA declarations are distinct state major disaster declarations whose incident type or title names a severe storm, tornado or hurricane; DR-4807 is filed under flooding but its title names severe storms. Severe winter storms are left out.
Owners and housing age in South Dakota
Half of South Dakota's homes were built in 1980 or earlier. The median year structure built is 1980 in table B25035 (ACS 5-year 2020-2024), and table B25034 puts the share built before 1980 at 49.7% for 2020-2024, including 64,494 units built in 1939 or earlier.
The state has 250,621 owner-occupied units out of 365,544 occupied units in table B25003 (ACS 5-year 2020-2024). Owners are the households that can agree to a roof replacement.
What South Dakota roofing buyers filter on
South Dakota buyers usually combine four fields:
- ZIP code: territory follows the counties in a hail or wind event, and buyers update it after each storm.
- Insurance claim status: a denied claim opens a fresh seventy-two-hour cancel window under section 37-24-51.
- Project type: storm repair, inspection or replacement on an older home.
- Homeowner status: the owner signs the storm repair contract, so renters are excluded.
