North Dakota law on claim-funded roof work

This section is general information, not legal advice. It summarizes official sources as of October 7, 2026; check the current text of each rule before relying on it.

North Dakota writes its roofing rules into the insurance title. Chapter 26.1-39.2 of the Century Code (as posted October 2026) defines a residential contractor as a person contracting with an owner to repair or replace a roof system or do other exterior work on a home of one to four units, and section 26.1-39.2-02 lets the homeowner cancel a contract paid from a property insurance policy before midnight of the later of the fifth business day after signing or the fifth business day after the insurer says in writing that the loss is not covered.

Other sections set paperwork duties. Section 26.1-39.2-03 bars promising to rebate any part of a deductible. Section 26.1-39.2-05 requires an itemized description of work, materials, labor and fees for the insured and the insurer before work starts. Section 26.1-39.2-06 requires a notice in capitalized fourteen-point type, signed by the named insured and sent to the insurer, stating that rebating a deductible is a violation of state insurance law. Under section 26.1-39.2-07, a contract is void if the contractor violates the chapter.

Hail and storm disasters in North Dakota

All three of North Dakota's qualifying major disasters were declared in the last two years. FEMA's Disaster Declarations Summaries, downloaded October 7, 2026, list DR-4888 (September 11, 2025) and DR-4895 (October 22, 2025), then DR-4934 (September 1, 2026), each for severe storms, straight-line winds and tornadoes.

Hail was recorded 198 times in North Dakota in the NOAA NCEI Storm Events 2025 details file. Each record carries a begin date and a county or forecast zone.

Method: a hail record is one 2025 Storm Events row for North Dakota with event type Hail, so a storm crossing four counties adds four rows. A FEMA declaration counts once if it is a state major disaster declared from January 1, 2023 whose incident type or title is a severe storm, tornado or hurricane. Severe winter storms are excluded.

North Dakota homes by owner and decade built

North Dakota's housing has a large recent layer as well as an old one. In table B25034 (ACS 5-year 2020-2024), units built from 2010 to 2019 number 69,654, the largest decade band in the table, while 47.8% of units were built before 1980. The median year built in table B25035 for the same period is 1982.

Owners occupy 208,084 of the state's 331,063 occupied units, per table B25003 (ACS 5-year 2020-2024). The remaining units are rented, which is why owner confirmation matters before a roofing appointment is set.

What North Dakota roofing buyers filter on

  • Insurance claim status: a claim-paid job falls under chapter 26.1-39.2, with its longer cancel window and the signed deductible notice, so buyers ask about the claim first.
  • Project type: a storm repair, a full replacement on a pre-1980 house, or work on a newer roof.
  • ZIP code: buyers draw territory from the ZIP codes their crews serve and adjust it after a declared storm.
  • Homeowner status: the chapter covers contracts with the owner or possessor, and buyers screen out renters.
