The North Dakota Insurance Department explains that "basic no-fault provides you coverage for economic loss (such as medical expenses and work loss) as a result of an accidental injury without regard to fault," that no-fault is also known as personal injury protection, and that "your auto's no-fault coverage is primary, regardless of fault." N.D.C.C. 26.1-41-06 puts that duty on every basic no-fault insurer of a secured motor vehicle, covering owners, relatives, occupants and pedestrians struck by the vehicle.
Stepping outside no-fault takes a serious injury. Section 26.1-41-08 exempts a secured person from liability for noneconomic loss "unless the injury is a serious injury," and section 26.1-41-01 defines that as an accidental bodily injury resulting in death, dismemberment, serious and permanent disfigurement or disability beyond sixty days, or medical expenses above a threshold set in the statute. Once a claim is in tort, N.D.C.C. 32-03.2-02 applies. Contributory fault does not bar recovery "unless the fault was as great as the combined fault of all other persons who contribute to the injury," and damages are reduced in proportion to the claimant's share.
