California uses a fault-based system for car accident injuries. Drivers carry liability insurance, and the California Department of Insurance describes bodily injury liability as coverage that "pays for bodily injury you cause someone else." There is no no-fault threshold to clear before an injured person claims against the driver who caused the crash, so the first questions a law firm client asks are about fault, injury and timing rather than a statutory severity test.
Timing is set by Code of Civil Procedure 335.1, which gives two years for an action for injury to, or the death of, an individual caused by the wrongful act or neglect of another. A crash from twenty months ago leaves a firm little time to investigate, collect records and file. That is why California MVA buyers set a maximum accident age filter well inside the two-year window, and why the accident date field on each lead matters as much as the phone number.
California follows pure comparative fault. Since Li v. Yellow Cab Co. (1975), a plaintiff's own negligence reduces damages rather than barring the claim, and the state civil jury instruction CACI 405 tells jurors to reduce damages by the plaintiff's percentage of responsibility. A claimant who was partly at fault can still recover something, so a California firm may accept a shared-fault accident that a buyer in a state with a 50 percent bar would decline. Civil Code 3333.4 adds a California-specific screen. An injured person may not recover non-economic losses such as pain and suffering if they owned a vehicle in the accident that was not insured as the financial responsibility laws require, if they drove and cannot establish financial responsibility, or if they were driving in violation of Vehicle Code 23152 or 23153 and were convicted. California home improvement leads: renters, owners and housing age
The Census Bureau puts California's owner-occupied housing unit rate at 55.9% for 2020-2024. California has its own telemarketing statutes on top of the federal TCPA: Bus. & Prof. Code 17590 to 17594, Pub. Util. Code 2871 to 2876, and Penal Code 632.
