Pennsylvania drivers choose their own tort option under 75 Pa.C.S. 1705. The Pennsylvania Insurance Department explains that limited tort offers premium savings, but the policyholder is not able to recover certain damages, such as payments for pain and suffering, unless the injuries meet one of the exceptions in the law. With full tort, the policyholder has unrestricted rights. A policyholder who fails to specially elect limited tort is deemed to have elected full tort.
Section 1705(d) sets the limit: a person bound by the limited tort election remains eligible to seek compensation for economic loss, but unless the injury sustained is a serious injury, is precluded from maintaining an action for any noneconomic loss, subject to listed exceptions. Section 1702 defines serious injury as a personal injury resulting in death, serious impairment of body function or permanent serious disfigurement. For buyers, the tort election on the claimant's policy is the Pennsylvania-specific field: a full tort claimant with a moderate injury can be a workable case, while a limited tort claimant with the same injury may not be.
Medical benefits coverage in Pennsylvania pays the medical bills for the policyholder and others covered by the policy regardless of fault, according to the Insurance Department guide. That first-party coverage handles early treatment bills; the tort claim against the other driver is where law firm clients focus.
Timing and fault follow statute. 42 Pa.C.S. 5524(2) requires an action for injuries to the person caused by the negligence of another to be commenced within two years. Under 42 Pa.C.S. 7102(a), the plaintiff's contributory negligence does not bar recovery where it was not greater than the causal negligence of the defendant or defendants, and damages are reduced in proportion to the plaintiff's share. A claimant more at fault than the defendants combined recovers nothing, so liability filters and an accident age limit well inside two years both apply.

Section 7 of the act gives the homeowner three business days after signing to rescind a home improvement contract without penalty, wherever it was signed.
