Limited tort, full tort and first-party medical benefits

The tort election is the Pennsylvania-specific fact on a car accident lead. The Pennsylvania Insurance Department Auto Insurance Guide (rev. October 2016) says limited tort offers premium savings, but the policyholder cannot recover certain damages, such as payments for pain and suffering, unless the injuries meet one of the exceptions in the law. Full tort keeps unrestricted rights, and a policyholder who never specially elects limited tort is deemed to have full tort.

Medical bills are paid first from the claimant's own policy. The same guide (rev. October 2016) lists medical benefits as a required coverage that pays medical bills for the policyholder and others covered by the policy regardless of fault, with a minimum limit of $5,000. Extraordinary medical benefits, an optional coverage, pay medical and rehabilitation expenses that exceed $100,000, up to a maximum limit of $1.1 million.

Pennsylvania minimum liability coverage

Pennsylvania drivers must maintain financial responsibility, and the Insurance Department guide (rev. October 2016) gives the minimums: bodily injury liability of $15,000 for injuries to one person and $30,000 total for one accident, and property damage liability of $5,000. It adds that some companies offer a $35,000 combined single limit that meets both minimums.

With minimums this low, the other driver's policy limit and the claimant's own underinsured motorist coverage often decide how much a case can recover, so buyers ask for both insurers where the claimant knows them.

Pennsylvania fatal and injury crashes, 2023

The NHTSA FARS state table counts 1,211 people killed in Pennsylvania motor vehicle traffic crashes in 2023, the latest year treated as final on this page. Those are deaths only; FARS does not count the injury crashes behind most leads.

PennDOT does. Its 2023 Pennsylvania Crash Facts and Statistics counts 48,346 injury crashes among the reportable crashes police filed that year, next to 1,132 fatal crashes.
