New York no-fault: basic economic loss and the serious injury line

This section is general information, not legal advice. It summarizes official sources as of October 7, 2026; check the current text of each rule before relying on it.

A New York injury claim starts with the claimant's own no-fault coverage. Insurance Law 5102(a) (revised May 29, 2026) defines basic economic loss as up to $50,000 per person of the listed items, such as medical expenses and lost earnings.

Suing the other driver is narrower. Between covered persons, Insurance Law 5104(a) (revised May 29, 2026) allows no recovery for non-economic loss except for a serious injury.

Section 5102(d) lists the categories, among them death, dismemberment, significant disfigurement, a fracture and several permanent or significant limitations of use. A lead that records a diagnosis such as a fracture gives a New York firm a direct match to that list.

Three years to sue, and the fault bar added for motor vehicle cases

New York allows more time than most states. CPLR 214(5) (version of February 25, 2022) requires an action to recover damages for a personal injury to be commenced within three years.

Fault follows two tracks in CPLR 1411 (revised May 29, 2026). Subsection (a) reduces damages in proportion to the claimant's culpable conduct without barring recovery. Subsection (b), for injury actions under article 51 of the Insurance Law, bars recovery when the claimant's culpable conduct is greater than the defendant's.

New York liability minimums: 25/50/10

The Department of Financial Services auto insurance page (as of October 2026) gives the minimums mandated by the Vehicle and Traffic Law: $25,000 for bodily injury, or $50,000 for injury resulting in death, to one person in one accident; $50,000 for bodily injury, or $100,000 for death, to two or more persons; and $10,000 per accident for property damage. DFS notes these are often called 25/50/10.

For a claimant who clears the serious injury line, the other driver's bodily injury limit is the first coverage a firm checks, so buyers often ask whether the other driver was insured.
