General Business Law 770(8) (revision of May 29, 2020) defines a roofing contractor as a person, including a nonresident contractor or subcontractor, engaged in the business of roofing, gutter, downspout or siding services for a fee, or who offers or solicits roofing-related services. Subdivision 3 of the same section lists siding among the named examples of home improvement.
Two duties in General Business Law 771-b (revision of May 29, 2020) follow from that definition:
- Written contract first: under subdivision 1, a roofing contractor signs a written contract meeting section 771 before engaging in roofing, gutter, downspout or siding services, and the contract names the insurer, the type of insurance coverage and the policy limits the contractor carries.
- No required deposit: under subdivision 5, a roofing contractor may not require a deposit for work and materials; the materials portion may be invoiced on delivery, with the material cost disclosed in writing first, and the rest on completion.
