New York is a no-fault state. Insurance Law 5104(a) says that in an action between covered persons for personal injuries arising out of negligence in the use or operation of a motor vehicle in the state, there is no right of recovery for non-economic loss except in the case of a serious injury, or for basic economic loss. The case a law firm can bring against the other driver therefore turns on whether the injury is a serious injury.
Insurance Law 5102(d) defines serious injury as a personal injury that results in death; dismemberment; significant disfigurement; a fracture; loss of a fetus; permanent loss of use of a body organ, member, function or system; permanent consequential limitation of use of a body organ or member; or significant limitation of use of a body function or system. Buyers can filter on injury type and diagnosis fields (a fracture, for example), which map to the serious injury definition.
Chapter 58 of the Laws of 2026 changed the rules for actions commenced on or after May 26, 2026, according to the Department of Financial Services. It removed the serious injury category for a non-permanent injury lasting 90 days during the 180 days after the accident, and it provides that liability for non-economic loss cannot be fixed until the trier of fact has determined that a serious injury exists. It also added CPLR 1411(b): in personal injury actions subject to article 51 of the Insurance Law, a claimant's culpable conduct bars recovery if it is greater than that of the person or persons against whom recovery is sought. Other New York injury actions remain under pure comparative fault in CPLR 1411(a). For motor vehicle buyers, liability filters now carry weight they did not carry before 2026.
The deadline is three years: CPLR 214(5) gives three years for an action to recover damages for a personal injury, subject to listed exceptions. A longer window does not make an old lead a good lead, and New York buyers still set an accident age limit, but the cutoff can differ from a buyer's two-year states.

New York home improvement leads: older housing, fewer owners
The Census Bureau puts New York's owner-occupied housing unit rate at 54.3% for 2020-2024. A large share of New York households rent, so homeowner confirmation and property type do a lot of the filtering work here.
The median year structure built is 1959 in the ACS 5-year estimates for 2020-2024, so half of the state's housing units were built in 1959 or earlier. Housing age is one input buyers use when choosing where to run roofing, siding and gutters, window and bathroom renovation campaigns. Buyers choose ZIP codes to match the areas their contractor clients serve, and can leave out ZIP codes where few requesters own their homes.
New York does not issue a statewide home improvement license. The Attorney General notes that home improvement contractors must be licensed in New York City and in Suffolk, Nassau, Westchester, Putnam and Rockland counties, so the licensing question depends on where the job is. The contract itself is regulated statewide: General Business Law 771 lets the owner cancel a home improvement contract until midnight of the third business day after signing, and the contract must say so.
