Illinois law requires all vehicle owners to carry minimum amounts of auto liability insurance, according to the Illinois Department of Insurance, and injury claims run against the driver who caused the crash. The Department's claim guidance explains that Illinois has a comparative negligence law, "which means that more than one person can be at fault in an accident." There is no no-fault threshold between an injured Illinois resident and a claim for pain and suffering, so the case turns on liability, injury and timing.
The line is set by 735 ILCS 5/2-1116: the plaintiff is barred from recovering damages if the trier of fact finds that the plaintiff's contributory fault is more than 50% of the proximate cause of the injury or damage. At 50 percent or less the claim survives, with damages reduced. The Department tells consumers the same thing in plain terms: you can generally collect damages if you are 50 percent or less at fault. Illinois also limits joint liability.
