An Illinois injury claim is paid by the liability insurance of the driver who caused the crash. The Auto Insurance Shopping Guide (Illinois Department of Insurance, as of October 2026) cites 625 ILCS 5/7-203 for bodily injury limits of at least $25,000 per person and $50,000 per accident.

Uninsured motorist coverage has its own floor. The same Department of Insurance guide (as of October 2026) lists uninsured motorist bodily injury minimums of $25,000 per person and $50,000 per accident, and it notes that underinsured motorist coverage becomes mandatory when a policyholder buys uninsured motorist limits above the minimum (215 ILCS 5/143a-2).

For a buyer, this means the size of an Illinois claim often depends on two policies: the other driver's liability coverage and the claimant's own uninsured or underinsured motorist coverage. A form that asks whether the other driver had insurance gives the receiving firm a first read on both.

How Illinois handles time limits and shared fault

Illinois draws its fault line just above half. In the Illinois Supreme Court's civil pattern jury instructions, section 45.00 (B45.01 revised August 2026), a jury returns a verdict for the defendant if it finds the plaintiff's contributory negligence was more than 50% of the total proximate cause of the injury. At 50% or less, the jury uses a verdict form for a plaintiff whose own negligence contributed.

The Illinois Department of Insurance claim guidance (as of October 2026) puts the same rule in consumer terms, saying a person can generally collect damages if they are 50.00% or less at fault. On timing, it says a bodily injury claim must be brought within 2 years from the date of the accident, or within 2 years from the 18th birthday for someone injured as a minor.
