Indiana liability coverage and the UM and UIM rule
This section is general information, not legal advice. It summarizes official sources as of October 7, 2026; check the current text of each rule before relying on it.
Indiana's financial responsibility law is built on liability coverage. IC 9-25-4-1 (2026 Indiana Code) says a person may not register a motor vehicle, or operate one on a public highway, unless financial responsibility is in effect. An injured claimant looks to the liability coverage of the driver who caused the crash.
When that driver had no coverage or too little, the claimant's own policy matters. Under IC 27-7-5-2 (2026 Indiana Code), insurers must provide uninsured and underinsured motorist coverage in limits at least equal to the policy's bodily injury liability limits unless the insured rejects it in writing, and underinsured motorist coverage may not be sold below $50,000. A lead that records the other driver's insurance status, and whether the claimant carried UM or UIM, gives an Indiana firm the coverage picture early.
Two years to sue, a fault bar, and shorter notice for government crashes
The general clock is two years: IC 34-11-2-4 (2026 Indiana Code) requires an action for injury to person to be commenced within two years after the cause of action accrues.
Crashes involving a public vehicle move faster. A claim against a political subdivision, such as a city or county, is barred unless notice is filed within 180 days after the loss, under IC 34-13-3-8 (2026 Indiana Code). For a claim against the state, IC 34-13-3-6 (2026 Indiana Code) sets the notice period at 270 days.
The Comparative Fault Act decides partial fault. Section 34-51-2-5 says a claimant's contributory fault diminishes the award proportionately and does not bar recovery except as section 34-51-2-6 provides; that section bars a claimant whose fault is greater than the fault of all persons whose fault contributed to the damages. The jury may also assign a share to a nonparty.

Indiana minimum liability amounts
IC 9-25-4-5 (2026 Indiana Code) sets the minimums at $25,000 for bodily injury to or the death of one individual and $50,000 for two or more individuals in one accident. Property damage rose from $10,000 to $25,000 per accident on July 1, 2018. Recovery vehicles over a set weight carry higher minimums under section 9-25-4-6.

NHTSA's FARS state fatality table lists 904 traffic deaths in Indiana for 2023, the latest year treated as final. FARS covers fatal crashes only, so it says nothing about the injury-only crashes that generate most car accident leads.
