Indiana MVA leads: financial responsibility and the Comparative Fault Act

Indiana uses a fault-based system. The Bureau of Motor Vehicles states that "a person may not operate a motor vehicle in Indiana if financial responsibility is not in effect," and after a crash for which the BMV receives an accident report, the driver must have the insurer file a Certificate of Compliance within ninety days or face suspension. The Indiana Department of Insurance adds that each newly written auto liability policy must include uninsured and underinsured motorist coverage unless the policyholder rejects it in writing. When the other driver had no insurance, the claimant's own UM coverage may still fund the claim, so an insurance status field is useful on Indiana leads.

Fault is set by the Indiana Comparative Fault Act. Under Indiana Code 34-51-2-6, the claimant is barred from recovery if the claimant's contributory fault is greater than the fault of all persons whose fault proximately contributed to the claimant's damages. Section 34-51-2-7 lets the jury assign part of the fault to a nonparty, so the percentages for the parties in the suit may total less than 100 percent. An Indiana firm wants to know about every driver involved, not only the one it plans to sue.

Section 34-51-2-2 adds a limit that matters for intake: the chapter "does not apply in any manner to tort claims against governmental entities or public employees" brought under IC 34-13-3. A crash with a city truck, a school bus or another public vehicle follows different rules, and firms often want those leads flagged or routed separately.

Timing follows Indiana Code 34-11-2-4: an action for injury to person must be commenced within two years after the cause of action accrues. Buyers set a maximum accident age well inside that period so the firm has time to investigate, gather treatment records and file.

Indiana home improvement leads: 70.6 percent owners, 1976 housing

The Census Bureau puts the Indiana owner-occupied housing unit rate at 70.6% for 2020-2024, so seven in ten Indiana households own the home they live in. Most requesters can sign for roofing, siding and gutters or window work themselves, and homeowner confirmation still screens out the renters.

The median year structure built for Indiana housing units is 1976 in the ACS 5-year estimates for 2020-2024, meaning half were built in 1976 or earlier. Homes of that age are into their second or third roof and often due for windows, siding and bathroom updates. Indiana buyers filter on project type and then pick the ZIP codes their contractor clients serve.

Indiana has no single statewide license for home improvement contractors. The Attorney General's consumer guidance notes that licensing requirements vary from community to community and sends homeowners to the local city or county building department, so a contractor's license status depends on where the job is. Indiana does regulate the sale itself: under the Home Solicitation Sales Act, Indiana Code 24-5-10-8, a consumer may cancel before midnight of the third business day after the later of receiving the required cancellation notice or finally agreeing to the contract.

Consent records and the Indiana Do Not Call list

Indiana adds its own Telephone Solicitation of Consumers law, Ind. Code art. 24-4.7, to the federal TCPA. It runs a state Do Not Call list that covers residential, wireless and VoIP numbers, and treats a text message to a wireless number as a telephone sales call. Telemarketers purchase the list of numbers they may not call; the Attorney General publishes it four times a year, on January 1, April 1, July 1 and October 1. The established business relationship exemption is narrower than federal rules and applies only to listed types of callers.
