Maryland is a fault-based state that also uses personal injury protection. The Maryland Insurance Administration explains that PIP "will reimburse you (or others named on your policy) for reasonable and necessary medical expenses resulting from an auto accident, as well as lost wages," and that this "will be made regardless of who caused the accident." Insurers must offer PIP; a policyholder may elect limited PIP, and certain individuals may reject it entirely. The MIA also warns that PIP can be denied if claims are not properly and timely filed.
PIP does not replace the tort claim. The MIA describes bodily injury liability as covering "medical expenses, loss of wages and pain and suffering that you may be legally responsible to pay to a person you have injured." There is no injury threshold to clear before an injured Marylander claims against the driver who caused the crash.
The deciding rule is contributory negligence. In Coleman v. Soccer Association of Columbia (July 9, 2013), the Court of Appeals of Maryland wrote that "we decline to abrogate Maryland's long-established common law principle of contributory negligence," leaving any change to the General Assembly. Under that rule, a plaintiff whose own negligence contributed to the injury is barred from recovering. For a Maryland firm, a lead where the caller was speeding, changed lanes or ran a light may be worth nothing however serious the injury. The Maryland Door-to-Door Sales Act sets a three business day cancellation right for door-to-door sales generally (Commercial Law 14-302), and Commercial Law 14-302.1 lengthens it for home improvement contracts: the buyer may cancel before midnight of the fifth business day after the transaction, or the seventh business day if the buyer is at least 65 years old.
