Maryland pairs fault-based claims with first-party injury benefits. Unless the coverage is waived or rejected, Insurance 19-505 (Maryland Code, as of October 2026) requires each insurer to provide personal injury protection worth at least $2,500. It pays reasonable medical expenses incurred within 3 years after the accident, 85% of income lost within that period, and household services.
PIP comes from the claimant's own insurer. The claim against the driver who caused the crash runs against that driver's liability coverage, so a Maryland lead can involve two payers: the claimant's PIP for early bills and lost wages, and the other driver's policy.
Contributory negligence and the three-year window in Maryland
Maryland still applies contributory negligence, under which a claimant whose own negligence contributed to the injury cannot recover. In Coleman v. Soccer Association of Columbia (Court of Appeals of Maryland, July 9, 2013), the court declined to abrogate that common law rule and left any change to the General Assembly.
Courts and Judicial Proceedings 5-101 (Maryland Code, as of October 2026) requires a civil action at law to be filed within three years from the date it accrues unless another provision sets a different period.

Transportation 17-103(b) (Maryland Code, as of October 2026) requires security covering bodily injury or death claims of up to $30,000 for one person and up to $60,000 for two or more persons, plus property damage claims of up to $15,000. Two statutes add accident-specific limits. Business Occupations and Professions 10-605.1 bars a lawyer, directly or through an agent, from sending a prospective client a letter, telephone, online, fax or recorded communication about an accident unless the accident occurred more than 30 days earlier, except at the prospective client's request (as of October 2026). Section 10-604 bars a person who is not a lawyer, without an existing relationship or interest in the issue, from accessing a police crash report for personal gain to solicit someone to sue or hire a lawyer.
