Delaware PIP and the claim against the other driver
This section is general information, not legal advice. It summarizes official sources as of October 7, 2026; check the current text of each rule before relying on it.
Delaware sits between the no-fault and at-fault models. Under 21 Del. C. 2118(a) (Delaware Code, as of October 7, 2026), an owner may not operate a registered vehicle without personal injury protection, and the minimum PIP limit is $15,000 for any one person and $30,000 for all persons injured in any one accident. PIP pays medical, hospital and related expenses, net lost earnings and the cost of personal services the injured person can no longer perform, for expenses incurred within 2 years from the date of the accident.
There is no tort threshold to cross. The injured person can still sue the driver at fault, but section 2118(h) (Delaware Code, 2026) bars pleading or introducing into evidence the damages for which PIP compensation is available. A Delaware case against the other driver therefore centers on pain and suffering and on losses above the PIP limit, which is why firms read the injury and treatment fields closely.
Delaware's two-year clock and the not-greater-than test
Time is short in Delaware. 10 Del. C. 8119 (Delaware Code, as of October 7, 2026) bars an action for personal injuries brought more than 2 years from the date on which the injuries are claimed to have been sustained.
Fault follows 10 Del. C. 8132 (Delaware Code, 2026). A plaintiff's contributory negligence does not bar recovery where it was not greater than the negligence of the defendant or the combined negligence of all defendants, and damages are reduced in proportion to the plaintiff's share. Under that wording, a claimant found exactly as negligent as the defendants can still recover a reduced amount.
For a buyer, the accident date shows how much of the two-year window remains for a firm to gather records, and the fault answers show whether the claimant is likely to stay at or below the defendants' share.
Liability minimums under the Delaware financial responsibility law
Section 2118 ties the liability part of the policy to the Financial Responsibility Law. That law, 21 Del. C. 2902(b)(2) (Delaware Code, as of October 7, 2026), sets limits of $25,000 for bodily injury to or death of one person, $50,000 for two or more persons in any one accident, and $10,000 for injury to or destruction of property of others in any one accident.
