Delaware writes gutters and siding into its consumer rules by name. The Department of Justice's 106 Home Improvement Services Regulation (27 DE Reg. 254, effective November 1, 2023), adopted under the Consumer Fraud Act, defines home improvement as any alteration, repair, addition, modification or improvement to a dwelling or its property, and its list of examples ends with roofs, gutters, downspouts and siding. New construction of a single-family home is outside the regulation.
Two of its unlawful practices bear on exterior sales. Section 3.1.26 bars misrepresenting or falsely stating that the buyer's present materials or property are dangerous, defective, or in need of repair or replacement. Section 3.1.9 requires a clear and conspicuous statement in the contract when a warranty covers only the product and not its installation or delivery.
