The Department of Justice Consumer Protection Unit adopted the 106 Home Improvement Services Regulation under the Consumer Fraud Act, final effective November 1, 2023, as published in the Delaware Register of Regulations (27 DE Reg. 254, October 1, 2023). Its list of prohibited practices includes failing to:

  • fill in all the relevant final terms before the buyer signs
  • put the contractor's name, address, telephone number, website (if any) and email address in the contract
  • include notice of the buyer's right to cancel where 6 Del. C. 4404(2) requires it
  • give the buyer the Consumer Protection Unit's summary of the regulation before the buyer signs
  • state clearly when a warranty covers only the product and not its installation or delivery

The regulation also bars a liquidated damages clause that pays the contractor the same amount no matter how much work is done. On the federal side, the FTC Cooling-Off Rule can let a buyer cancel certain in-home sales.
