The Department of Justice's home improvement regulation has rules that touch how flooring is sold. The 106 Home Improvement Services Regulation (effective November 1, 2023) lists as unlawful practices:
- presenting models or samples as current when they are discontinued (3.1.23)
- claiming a discount because materials are left over from another job when that is not so (3.1.20)
- leaving delivery and installment charges out of the contract (3.1.8)
Section 1.2 of the same regulation (27 DE Reg. 254, 2023) states that it does not cover new construction of single-family dwellings or the rebuilding of all or substantially all of an existing one.
Before the Division of Revenue issues a contractor license, 30 Del. C. 2502(b) (Delaware Code, 2026) requires a Department of Labor certificate of notice that the person will perform labor on a Delaware construction project, and a certificate showing workers' compensation insurance or qualified self-insurer status.
