Under 21 Del. C. 2118(a), no owner of a vehicle required to be registered in Delaware may operate it or let anyone else operate it "unless the owner has insurance on such motor vehicle providing the following minimum insurance coverage," which includes liability cover and personal injury protection. PIP pays medical, hospital and related expenses, net lost earnings and the cost of personal services the injured person can no longer perform. Delaware keeps the tort claim against the driver at fault; PIP is a first layer of benefits, not a threshold that must be cleared before suing.
Section 2118(h) shapes what a Delaware case is worth. A person eligible for PIP benefits "is precluded from pleading or introducing into evidence in an action for damages against a tortfeasor those damages for which compensation is available" under PIP. The claim against the other driver centers on pain and suffering and losses beyond PIP, so the injury description and ongoing treatment are the fields Delaware firms read first.
Fault follows 10 Del. C. 8132. Contributory negligence does not bar recovery "where such negligence was not greater than the negligence of the defendant or the combined negligence of all defendants against whom recovery is sought," and damages are reduced by the plaintiff's share. Timing follows 10 Del. C. 8119: no action for personal injuries may be brought "after the expiration of 2 years from the date upon which it is claimed that such alleged injuries were sustained." The Census Bureau puts Delaware's owner-occupied housing unit rate at 73.0% for 2020-2024, and the median year structure built is 1987 in the ACS 5-year estimates for 2020-2024, so half of the state's housing units were built in 1987 or later. Under 30 Del. C. 2502, any person who wants to do business in Delaware as a contractor must obtain a license from the Division of Revenue, and the Division says contractors register through a resident or non-resident contractors package. This is a business license rather than a trade exam. In 2023 the Department of Justice's Consumer Protection Unit also issued home improvement regulations that require a written contract listing all material terms and a completion date unless clearly disclosed otherwise. For in-home sales, 6 Del. C. chapter 44 lets the buyer cancel a home solicitation sale before midnight of the third business day after the transaction.
