When the at-fault driver carries only the minimum, those first-party coverages can matter to the value of the claim, so a firm reviewing a lead wants to know what both drivers carried.

Two years to file and fault weighed against everyone else

The filing deadline is two years. In No. 24-ICA-186 (filed December 23, 2024), the Intermediate Court of Appeals quoted W. Va. Code 55-2-12: a personal action for damages for personal injuries must be brought within two years after the right to bring it accrued.
