West Virginia is fault-based. Owners must show proof of financial responsibility under W. Va. Code 17D-4-2, which sets minimum liability limits for bodily injury to or death of one person and of two or more persons in any one accident. That liability coverage answers for the injuries a driver causes, and there is no no-fault threshold to meet before an injured person makes a claim.

Section 55-7-13c governs shared fault. A plaintiff is barred only if "the plaintiff's fault is greater than the combined fault of all other persons responsible for the total amount of damages." Otherwise, recovery is reduced in proportion to the plaintiff's degree of fault. Because the comparison runs against every other responsible person together, a multi-vehicle crash can leave a claimant with a real share of the blame still holding a claim. Buyers ask for the number of vehicles, who was cited and how the crash happened.

Section 55-2-12 requires an action for damages for personal injuries to be brought within two years next after the right to bring it accrued. West Virginia firms want time to gather records and negotiate inside that window, so MVA buyers set a maximum accident age filter and want the accident date on every lead.

Code 30-42-6, no person may engage in any activity as a contractor or bid on work as a contractor without a license issued under the Contractor Licensing Act, and section 30-42-3 names the West Virginia Contractor Licensing Board. The definition of contractor applies to residential work above a project-size threshold set in the statute. For in-home sales, W. Va. Code 46A-2-132 gives the buyer the right to cancel a home solicitation sale until midnight of the third business day after signing.
