The Hawaii Insurance Division describes Hawaii as a no-fault state, meaning the injured person's own motor vehicle insurer pays the bills for their injuries and their passengers' injuries up to the personal injury protection limit, "and you cannot sue or be sued unless there are serious injuries." For a buyer, a Hawaii MVA lead is only as good as the injury behind it.
HRS 431:10C-306 spells out what counts. Tort liability is abolished for motor vehicle accidents in Hawaii except where death occurs; where the injury consists in whole or in part of a significant permanent loss of use of a part or function of the body; where it is a permanent and serious disfigurement that causes mental or emotional suffering; or where the PIP benefits incurred reach an amount set in the statute. Once a claim is over the threshold, HRS 663-31 sets the fault rule. Contributory negligence does not bar recovery if it "was not greater than the negligence of the person or in the case of more than one person, the aggregate negligence of such persons against whom recovery is sought," and damages are reduced by the claimant's share. A claimant exactly half at fault still recovers half.
Timing has two layers. HRS 657-7 sets two years for injury to persons, and for motor vehicle cases HRS 431:10C-315 allows a tort suit up to the later of two years after the accident or two years after the last payment of motor vehicle insurance benefits or of workers' compensation or public assistance benefits arising from it.
