Hawaii's Insurance Division describes the state as a no-fault state, where a person's own motor vehicle insurer pays the bills for their injuries and their passengers' injuries up to the personal injury protection limit. Its motor vehicle insurance page (as of October 2026) sets that limit at $10,000 per person and adds that you cannot sue or be sued unless there are serious injuries.

The tort threshold decides which claims leave the no-fault system. In Mobley v. Kimura (Hawaii Supreme Court, March 13, 2020), the court explained that HRS 431:10C-306(a) abolishes tort liability for motor vehicle accidents in Hawaii unless an exception in subsection (b) applies, including an injury that consists in a significant permanent loss of use of a part or function of the body, or $5,000 in PIP benefits incurred.

That makes injury severity and PIP spending the core of a Hawaii lead. A buyer wants to know what was injured, how treatment has gone and whether PIP is still paying, because those answers show whether a claim can reach the threshold.

When a Hawaii tort suit must be filed, and how fault is compared

Hawaii ties its motor vehicle tort deadline to benefit payments as well as the crash. Mobley v. Kimura (2020) quotes HRS 431:10C-315(b): no suit arising out of a motor vehicle accident shall be brought in tort more than the later of several dates, including two years after the last payment of motor vehicle insurance benefits and two years after the last payment of workers' compensation or public assistance benefits arising from the accident.

Fault is compared once a claim is in tort. Hawaii Civil Jury Instruction No. 6.4 (amended to March 2022) tells jurors that if the plaintiff's negligence is 50% or less, the court reduces the award by that share, and that if it is more than 50%, the plaintiff recovers nothing.
