Alaska crash claims are made against the liability policy of the responsible driver. The Division of Insurance Consumer Guide to Automobile Insurance (revised September 2020) says the owner or operator of a vehicle registered for road use must carry at least the legally required minimum liability insurance, which protects against claims for an accident "for which you are found to be legally responsible."

Two first-party coverages sit beside it. The same guide calls medical payments an optional coverage that, unlike bodily injury liability, can pay without a determination of negligence. And AS 21.96.020(c) (2026) requires an insurer selling bodily injury liability in Alaska to offer uninsured and underinsured motorist coverage initially and at each renewal.

For a lead, this means the other driver's liability policy is the main source of recovery, with the claimant's own medical payments and uninsured motorist coverage as possible additions. Buyers ask about both sides' insurance.

Alaska fault reduces an award but does not end it

Alaska follows pure comparative fault. AS 09.17.060 (2026) says contributory fault chargeable to the claimant diminishes the compensatory award proportionately "but does not bar recovery." A claimant found mostly at fault can still recover the share caused by the other driver.

The deadline is short. Under AS 09.10.070(a) (2026), an action for personal injury or death must be commenced within two years of the accrual of the cause of action.

AS 28.22.101(d) (2026) requires a motor vehicle liability policy to cover, for each vehicle, $50,000 for bodily injury to or death of one person in one accident, $100,000 for bodily injury to or death of two or more persons in one accident, and $25,000 for injury to or destruction of property of others in one accident.

Under AS 21.96.020(c) (2026), the uninsured and underinsured motorist coverage an insurer offers may not be written below the AS 28.22.101 limit, and the offer must include options with higher limits, starting at $100,000 per person and $300,000 per accident.
