Its drivers carry liability insurance, and the Department of Insurance guide (Form 101, revised February 5, 2025) states that bodily injury liability "pays for bodily injury you cause someone else." The same guide describes uninsured motorist coverage as protection in an accident with a driver who has no liability insurance or is underinsured. A lead that records whether the other driver was insured tells a firm which of those two paths a claim is likely to take.
Shared fault reduces the award; two years to file
The Judicial Council's jury instruction on a plaintiff's own negligence contains no cutoff percentage. CACI No. 405 (2025 edition) tells jurors that if the defendant proves the plaintiff was negligent and that the negligence was a substantial factor in the harm, the plaintiff's damages are reduced by the jury's determination of the plaintiff's percentage of responsibility. The instruction says nothing about barring the claim at any share of fault.
The filing window is two years. The California courts' self-help guide on deadlines to sue (as of October 7, 2026) lists personal injury at two years from the date of injury, citing Code of Civil Procedure section 335.1. It adds that suits against a government agency, or someone working for one, carry different deadlines and an earlier claim requirement.
For a buyer, the two rules point in different directions. Shared-fault leads stay in play because fault reduces rather than ends a claim, while the accident date decides whether a firm has time to work the file. Whether a government vehicle was involved is a third field some California buyers add.
California's minimum liability limits
The Department of Insurance guide (Form 101, revised February 5, 2025) gives the minimums as $30,000 for the death or injury of any one person, $60,000 for the death or injury of more than one person in any one accident, and $15,000 for damage to the property of other people. A serious injury claim can exceed those amounts, which is why buyers ask what coverage the other driver had.
The California DMV insurance requirements page (as of October 7, 2026) lists the same minimums under Insurance Code 11580.1b and accepts three alternatives to a policy: a $75,000 cash deposit with DMV, a $75,000 surety bond or a DMV self-insurance certificate.

NHTSA's Fatality Analysis Reporting System counts 4,169 people killed in California motor vehicle traffic crashes in 2023, the latest year used here as final. FARS reports deaths only; injury crashes, which produce most car accident claims, are outside its count.
