West Virginia sets a dollar line for residential work. In section 30-42-3(d) of the Contractor Licensing Act (effective July 24, 2022), a contractor is a person who, for compensation, undertakes or bids to construct, alter, repair or improve a structure where the cost of the undertaking is $5,000 or more for residential work or $25,000 or more for commercial work. The definition leaves out a person who works on property they own or lease and a person who only supplies materials without installing them.
The board's rule 28CSR2 (effective May 1, 2022) lists the classifications it examines for. Two fit most flooring jobs in homes. A remodeling and repair contractor handles general remodeling, additions and repairs to existing structures that require two or more classifications, where the undertaking does not exceed $40,000, and a residential contractor is treated as licensed for every classification needed on a residential structure. Section 5.4 of the rule sets an annual fee of $90 for most applicants.
