Missouri uses a fault-based system. RSMo 303.025 says no owner of a motor vehicle registered in the state shall operate, register or maintain registration of it, or permit another person to operate it, "unless the owner maintains the financial responsibility" the law requires. An injured person claims against the driver who caused the crash, with no no-fault threshold to clear first.
Missouri follows pure comparative fault. In Gustafson v. Benda, decided December 20, 1983, the Supreme Court of Missouri adopted comparative fault under the Uniform Comparative Fault Act, replacing contributory negligence and the last clear chance doctrine. A claimant's damages are reduced by their own share of fault rather than barred at any percentage. A Missouri firm may therefore look at shared-fault crashes that turn on the size of the claimant's share, and liability fields (who was cited, point of impact, witness statements) help it judge that share.
Timing is set by RSMo 516.120(4), which gives five years for an action for "any other injury to the person or rights of another, not arising on contract." The Missouri House passed HB 68 in February 2025, which would have cut the period to two years for injuries after August 28, 2025, but section 516.120 as published by the Revisor of Statutes still reads five years. The cancellation right is statewide: RSMo 407.705 gives a buyer until midnight of the third business day after signing to cancel a home solicitation sale, with Saturdays, Sundays and legal holidays not counted as business days.
