The Minnesota Department of Commerce explains that the No-Fault Automobile Insurance Act requires drivers to maintain basic economic loss benefits and liability coverage. The no-fault part of the policy pays medical expenses, lost wages and replacement services, and "these costs are paid no matter who is at fault." The Department also notes that no-fault claims must be made within six months of the accident, a date intake teams should capture alongside the accident date.
A claim against the other driver for noneconomic loss (pain and suffering) depends on Minnesota Statutes 65B.51, subdivision 3. Those damages are available only if reasonable medical expenses pass a threshold set in the statute, or if the injury results in permanent disfigurement, permanent injury, death, or disability for 60 days or more.
