Under KRS 304.39-060, anyone who registers, operates or uses a motor vehicle on Kentucky roads is deemed to have accepted the no-fault provisions of the Motor Vehicle Reparations Act. Tort liability is abolished to the extent basic reparation benefits are payable. The same section lets any person refuse those limits, in writing or electronically on a form prescribed by the Department of Insurance, filed before any accident. That choice is why Kentucky is described as a choice no-fault state, and why a buyer may want to know whether the claimant or the other driver had rejected the limits.
For a claimant who kept the no-fault limits, a claim for pain and suffering against the other driver depends on the threshold in KRS 304.39-060(2)(b). Medical expenses must pass an amount set in the statute, or the injury must be permanent disfigurement, a fracture to a bone, loss of a body member, permanent injury within reasonable medical probability, permanent loss of bodily function or death. A broken bone clears it alone. Injury type and treatment status are the two lead fields that speak to it.
Timing in Kentucky car accident claims follows KRS 304.39-230(6): a tort action not abolished by the no-fault law may be commenced not later than two years after the injury, the death, or the date of the last basic or added reparation payment, whichever occurs later. Because the clock can restart with each PIP payment, accident date alone does not fix the deadline, but buyers still set an accident age limit so a firm has time to work the file.
Fault is apportioned under KRS 411.182, which has the jury find the damages each claimant would recover if contributory fault were disregarded and the percentage of total fault of each party. Kentucky has applied pure comparative fault since Hilen v. Hays (1984), so a partly at-fault claimant is not barred, and the award is reduced by the claimant's share. Kentucky home improvement leads: 68.3 percent owners and roofing rules
The Census Bureau puts the Kentucky owner-occupied housing unit rate at 68.3% for 2020-2024, and the median year structure built is 1982 in the ACS 5-year estimates for 2020-2024. Homeowner confirmation still screens out renters, and buyers choose project types (roofing, siding and gutters, windows, bathroom renovation, flooring) and then the ZIP codes their contractor clients serve.
Kentucky has no state license for roofing contractors. House Bill 150 of the 2026 session, which would have required one through the Department of Housing, Buildings and Construction, was sent to the House licensing committee in January 2026 and was not enacted. Two consumer statutes do apply. KRS 367.420 lets a buyer cancel a home solicitation sale until midnight of the third business day after signing. KRS 367.622, as amended in 2025, lets a homeowner who signs a repair or construction contract tied to an insurance claim cancel before midnight of the fifth business day after the insurer gives written notice that all or part of the claim is not covered.
