Alabama MVA leads: contributory negligence and two years

Alabama crash claims run through the tort system. The Alabama Department of Insurance explains that bodily injury liability covers claims from people injured if the policyholder causes an accident, including medical expenses and lost wages, and that uninsured motorist coverage pays the policyholder when a hit-and-run or uninsured driver causes the injury. There is no no-fault benefit that must be used up before a claim.

Alabama has not adopted comparative fault. In Williams v. Delta International Machinery Corp. (1993), the Alabama Supreme Court declined to abandon contributory negligence, noting it had been the law in Alabama for about 162 years. Under that rule a plaintiff whose own negligence contributed to the accident is generally barred from recovering. The Alabama Home Builders Licensure Board regulates residential construction and remodeling under Code of Alabama Title 34, Chapter 14A. A license is required for residential construction, remodeling, repair or improvement work above a project-size threshold set in the statute, and the Board issues separate license types, including a roofers license for residential roofing. For sales made at the home, Code of Alabama 5-19-12, part of the Alabama Consumer Credit Act, lets the buyer cancel a home solicitation sale until midnight of the third business day after signing, and the federal FTC Cooling-Off Rule (16 CFR Part 429) gives three business days for other covered sales.
