Alabama ties a car accident claim to the liability coverage on the vehicle that caused it. Code of Alabama 32-7A-4 (as of October 2026) says no person may operate, register or keep the registration of a vehicle used on a public highway unless it is covered by a liability insurance policy, a motor vehicle liability bond or a cash deposit, in at least the amounts set in section 32-7-6(c).

An injured person's claim therefore runs against the other driver's liability coverage. The Alabama Department of Revenue (as of October 2026) runs the mandatory liability insurance program and suspends the registration of a vehicle found to be uninsured.

Two years to file, and how fault is raised in Alabama

Alabama gives injured people two years. Section 6-2-38(l) (Code of Alabama, as of October 2026) states that all actions for any injury to the person or rights of another not arising from contract, and not listed elsewhere in the section, must be brought within two years.

Fault in an Alabama crash case is argued as contributory negligence, a term the legislature uses directly in the safety belt law. Code of Alabama 32-5B-7 (as of October 2026) says failure to wear a safety belt "shall not be considered evidence of contributory negligence" and does not limit an insurer's liability. The Supreme Court of Alabama rewrote its advertising rules in an order dated May 13, 2025, effective January 1, 2026, published by the Alabama State Bar. The amended rules are:
