Florida no-fault insurance and what it means for a car accident lead

Every Florida auto policy carries personal injury protection. Section 627.736 (2026 Florida Statutes) sets the benefit at a limit of $10,000 in medical and disability benefits and $5,000 in death benefits. The injured person's own PIP pays those benefits first, whoever caused the crash.
Two PIP rules in section 627.736 (2026 Florida Statutes) shape which Florida leads are workable. Medical benefits are payable only if the person receives initial services and care within 14 days after the accident. If a treating provider determines that the person did not have an emergency medical condition, reimbursement is limited to $2,500. A lead that records the date of first treatment, and where that treatment happened, tells a Florida firm which of those two lines the claimant sits on.
Pain and suffering sits outside PIP. Under section 627.737(2) (2026 Florida Statutes), a claimant can recover those damages from the other driver only for significant and permanent loss of an important bodily function, permanent injury within a reasonable degree of medical probability (other than scarring or disfigurement), significant and permanent scarring or disfigurement, or death. Injury detail on the lead is how a buyer judges whether a claim can clear it.
The two-year deadline and the 50 percent bar
Florida's negligence deadline is two years. Section 95.11(5)(a) (2026 Florida Statutes) lists an action founded on negligence among the actions that must be brought within two years. The two-year rule came in with CS/CS/HB 837 (2023), chapter 2023-15.
Fault works on a modified comparative basis. Section 768.81(6) (2026 Florida Statutes) says a party found to be more than 50 percent at fault for their own harm may not recover any damages in a negligence action under that section. A claimant at 40 percent fault can still recover a reduced amount; a claimant at 51 percent cannot.
Both rules turn directly into lead filters. The accident date shows how much of the two-year window is left, and the fault answers (who hit whom, whether a citation was issued) show which side of the section 768.81(6) fault line the claimant is likely to fall on.
Minimum auto coverage in Florida
Florida's financial responsibility law sets the property damage minimum. Section 324.022(1) (2026 Florida Statutes) requires owners and operators to maintain $10,000 because of damage to, or destruction of, property of others in any one crash. With the $10,000 PIP benefit in section 627.736, those are the two statutory minimums this page relies on.
