It is a no-fault state with a statutory injury threshold, it changed both its injury deadline and its comparative fault rule in 2023, and its telemarketing statute requires written consent for automated sales calls. Florida is a no-fault state. Section 627.736 requires auto policies to provide personal injury protection to the named insured, resident relatives, occupants and some pedestrians for medical and disability benefits. PIP reimburses medical services only if the injured person receives initial services and care within 14 days after the accident, which makes the date of first treatment a field worth capturing on every Florida lead.
Suing the other driver for pain and suffering requires clearing the tort threshold in section 627.737(2). A plaintiff may recover those damages only if the injury consists in whole or in part of significant and permanent loss of an important bodily function, permanent injury within a reasonable degree of medical probability (other than scarring or disfigurement), significant and permanent scarring or disfigurement, or death. Florida firms therefore look for injury detail (treatment received, diagnosis, imaging, ongoing care) far more than firms in fault-based states, and buyers filter on documented injury accordingly.
HB 837, chapter 2023-15, took effect on March 24, 2023 and changed two rules buyers depend on. Section 95.11 now lists an action founded on negligence under "within two years," so the Florida injury window is two years. Section 768.81(6) now says any party found to be greater than 50 percent at fault for his or her own harm may not recover any damages. Florida moved from pure to modified comparative fault, and liability filters became as important as injury filters.

Florida home improvement leads: high ownership, 1980s housing
The Census Bureau puts Florida's owner-occupied housing unit rate at 67.6% for 2020-2024, higher than Texas, California and New York. More owners means a larger share of Florida home improvement requests come from people who can sign for the work, though homeowner confirmation remains a standard filter.
The median year structure built for Florida housing units is 1988 in the ACS 5-year estimates for 2020-2024. Florida housing sits between Texas and the older Northeast and California stock, so a statewide Florida campaign mixes ZIP codes with very different housing ages. Buyers filter on project type (roofing, flooring, siding and gutters, bathroom renovation, bathroom and windows) and on the ZIP codes their clients serve.
Florida licenses contractors through the Construction Industry Licensing Board under Chapter 489 of the Florida Statutes. The board issues certified licenses, valid statewide, and registered licenses, valid only in the local jurisdictions where the contractor met competency requirements, for categories that include residential and roofing contractors. Section 489.128 makes a contract signed by an unlicensed contractor unenforceable by that contractor. Under section 501.025, a buyer may cancel a home solicitation sale until midnight of the third business day after signing.

Consent records and the Florida Telephone Solicitation Act

The Florida Telephone Solicitation Act (Fla. Stat. 501.059, amended in 2021 and 2023, with call limits in 501.616(6)) requires prior express written consent, with a clear and conspicuous disclosure, for sales calls that use an automated system for the selection and dialing of numbers or a recorded message. It limits commercial solicitation calls to between 8 a.m. and 8 p.m. in the called person's time zone and to three calls in 24 hours on the same subject. Since 2023, a consumer must first reply STOP to a text and the sender has 15 days to stop before a text-based suit can be filed. For Florida buyers the written consent language on the lead, and the record that proves it, carry extra weight because of the FTSA.
