Georgia has no personal injury protection threshold to clear. The Office of the Commissioner of Insurance and Safety Fire (auto insurance page, 2026) says every driver must carry liability insurance, which pays damages to others when the policyholder is ruled at-fault. An injured claimant looks first to the other driver's liability carrier.

The bigger Georgia change for buyers came in 2025. Senate Bill 68 (2025 session) added Code section 51-12-1.1, which limits medical special damages to the reasonable value of medically necessary care. If the plaintiff has health insurance, the evidence includes both the amounts charged and the amounts needed to satisfy them under the policy.

Georgia stops recovery at an even split. In a Supreme Court of Georgia decision of August 10, 2021 (Case No. S20G1419), the court quoted O.C.G.A. 51-12-33(g): the plaintiff is not entitled to any damages if the plaintiff is 50 percent or more responsible for the injury or damages claimed. Below that line the award is reduced by the plaintiff's share.

Seat belt use now feeds that percentage. As rewritten by SB 68 section 5 (2025), O.C.G.A. 40-8-76.1(d)(1) says the failure to wear a seat safety belt may be considered in any civil action on negligence, comparative negligence, causation and apportionment of fault, and may diminish recovery.

As revised by Senate Bill 8 (2015), O.C.G.A. 9-3-33 requires actions for injuries to the person to be brought within two years after the right of action accrues.

Timing decides which rules a claim meets. Section 9 of SB 68 makes the Act effective on the Governor's approval, and the Senate Research Office summary (2025) records the signature on April 21, 2025. Sections 6 and 7, which include the medical damages section, apply only to causes of action arising on or after that date. Buyers therefore read the accident date and the fault answers together.
