The definition of residential home builder in Code of Alabama 34-14A-2(16) (2026 text, through Act 2024-443) includes a person who, for a price or fee, undertakes the repair, improvement or reimprovement of a residence when the cost of the undertaking exceeds $10,000. Subdivision (5) of the same section defines that cost as the total of materials, labor, supervision, overhead and profit.
Working without the license is a crime. The Home Builders Licensure Board's unlicensed builders page (checked October 7, 2026) cites Ala. Code 34-14A-14(a): a person who undertakes residential home building without a current license is guilty of a Class A misdemeanor.
Owners who hire a licensee can claim against the board's Homeowners' Recovery Fund (checked October 7, 2026) only after a court judgment, and a consent judgment does not count. Payments stop at $30,000 for one transaction and $90,000 for the actions of one licensee, and cover actual economic damages only.
