Colorado claims follow fault. The Colorado Division of Insurance describes liability coverage as paying "bodily injury damages to another person and property damage to another's property that are the result of an accident in which you are found to be at fault." The deadline for a Colorado vehicle case sits in its own clause. C.R.S. 13-80-101(1)(n) places all tort actions for bodily injury or property damage arising out of the use or operation of a motor vehicle within the three-year general limitation of actions. That window leaves room for accidents that are months old, though law firm clients still want time to gather records, so Colorado campaigns usually cap accident age well inside three years.
Fault is compared under C.R.S. 13-21-111. Contributory negligence does not bar recovery "if such negligence was not as great as the negligence of the person against whom recovery is sought," and damages are reduced by the claimant's share. The wording matters: a claimant found exactly 50 percent at fault is not less at fault than the other driver, so the claim fails.
