A Colorado policy comes with two first-party coverages already in it. The Colorado Division of Insurance (as of October 7, 2026) says medical payments coverage of $5,000 is included unless the policyholder rejects it, and pays reasonable health care expenses for the policyholder and passengers regardless of fault. Uninsured and underinsured motorist coverage is described as optional, but it is also included unless rejected in writing.
Liability is the required coverage, and it follows fault. The Division describes it as paying bodily injury and property damage to others that result from an accident in which the policyholder is found to be at fault. There is no no-fault threshold to clear before a claim against the other driver, so a lead's value turns on fault, injury and timing.
Three years for a vehicle claim, and the equal-fault line
Motor vehicle injury cases have their own clause in Colorado's limitation statute. In 2025COA81 (October 2, 2025), the Court of Appeals quoted section 13-80-101(1)(n)(I): all tort actions for bodily injury or property damage arising out of the use or operation of a motor vehicle must be commenced within three years after the cause of action accrues.
Fault is measured head to head. The Judicial Branch's pattern instruction CJI-Civ 9:26 (2026 edition) tells the jury that if the plaintiff's negligence was equal to or greater than the defendant's, the plaintiff will not be allowed to recover; if the defendant's was greater, the court reduces the award by the plaintiff's percentage.

Minimum liability coverage in Colorado

In Rule Change 2020(29), adopted by the Colorado Supreme Court on September 10, 2020, the court rewrote rules 7.1 to 7.5 of the Colorado Rules of Professional Conduct. Paragraph (d) bars solicitation by any media concerning personal injury or wrongful death, cites section 13-93-111, C.R.S., and does not apply to a communication issued more than 30 days after the event, or where a family or prior business or professional relationship exists.
