New Mexico fault-based insurance and the uninsured motorist layer

New Mexico has no personal injury protection system. Its Mandatory Financial Responsibility Act, in section 66-5-205 (NMSA 1978, as of October 2026), says no owner shall permit, and no person shall drive, an uninsured motor vehicle on New Mexico streets or highways. The Office of Superintendent of Insurance (April 2022) explains that when a driver is found at fault, that driver's insurer pays the other parties' medical and property costs up to the policy limits.
Uninsured motorist coverage comes with every policy unless it is turned down. Section 66-5-301 (NMSA 1978, as of October 2026) bars issuing a liability policy in New Mexico without uninsured motorist coverage, which must include underinsured motorist coverage, and gives the named insured the right to reject it. The same section allows an exclusion of not more than the first $250 of property damage loss.
Three years to file and no fault cutoff in New Mexico
New Mexico does not bar a claim because the injured person shares the blame. The official annotations to Chapter 41 of the NMSA 1978 (as of October 2026) note that the New Mexico Supreme Court adopted pure comparative negligence and several liability, and section 41-3A-1 abolishes joint and several liability, with listed exceptions, in causes of action where comparative fault applies.
The filing period is three years. Section 37-1-8 (NMSA 1978, as of October 2026) requires an action for an injury to the person to be brought within three years.
Because fault reduces value rather than ending the claim, New Mexico buyers use the liability answers to estimate a case, and the accident date to keep it well inside the three years.
New Mexico 25/50/10 minimums
Section 66-5-208 (NMSA 1978, as of October 2026) defines evidence of financial responsibility as the ability to respond in damages of $25,000 for bodily injury to or death of one person, $50,000 for two or more people in one accident, and $10,000 for property damage.
