Arizona's fault system and the coverage questions behind a lead

Arizona attaches the duty to insure to the vehicle. A.R.S. 28-4135 (2026 Arizona Revised Statutes) says a motor vehicle operated on an Arizona highway must be covered by a liability policy at the section 28-4009 limits, an alternate method of coverage, a certificate of self-insurance, or a policy meeting the financial responsibility article. No personal injury protection benefit or tort threshold comes first; the claim goes to the at-fault driver's carrier.

The claimant's own policy can matter as much. Under A.R.S. 20-259.01 (2026), every insurer writing auto liability policies must offer uninsured motorist coverage and underinsured motorist coverage by written notice, in limits not less than the policy's bodily injury limits, and include them on request. Arizona also does not cap the amount. Article 18, section 6 of the Arizona Constitution says the right of action to recover damages for injuries shall never be abrogated and the amount recovered is not subject to any statutory limitation, apart from a felony-related exception.

Shared fault reduces, two years limits

Arizona does not cut a claimant off at a fault percentage. A.R.S. 12-2505(A) (2026) makes contributory negligence a question of fact for the jury and says that if the jury applies it, the claimant's action is not barred; full damages are reduced in proportion to the claimant's relative degree of fault. A claimant who intentionally, wilfully or wantonly caused or contributed to the injury has no right to comparative negligence.

The time limit is short. A.R.S. 12-542 (2026) requires actions for injuries done to the person of another to be commenced and prosecuted within two years after the cause of action accrues.

Arizona buyers therefore weigh the accident date harder than the fault answer. Fault fields still matter, because they set how much an award shrinks, but a partly at-fault claimant remains a possible case, while an old accident date can leave too little of the two years.

Arizona raised its minimum limits in 2020

A.R.S. 28-4009 (2026 Arizona Revised Statutes) sets two schedules. Policies issued or renewed on or before June 30, 2020 carry at least $15,000 for one person, $30,000 for two or more persons and $10,000 for property damage. Policies issued or renewed from July 1, 2020 carry at least $25,000, $50,000 and $15,000. The $15,000 property damage floor is lower than the bodily injury pair, so vehicle damage claims can exceed it.
