Arizona runs on fault. A.R.S. 28-4135 says a vehicle operated on an Arizona highway must be covered by a motor vehicle liability policy at the limits in section 28-4009, or by another approved form of financial responsibility. An Arizona crash claim is made against the negligent driver and that driver's liability carrier, and nothing in Arizona law makes the claimant first clear a no-fault injury threshold.
That right has constitutional footing. Article 18, section 6 of the Arizona Constitution provides that the right of action to recover damages for injuries shall never be abrogated and that the amount recovered shall not be subject to any statutory limitation, with an exception for people injured while committing or fleeing a felony. Arizona follows pure comparative fault under A.R.S. 12-2505. Contributory negligence is always a question of fact left to the jury, and if the jury applies it the claimant's action is not barred; full damages are reduced in proportion to the claimant's share of fault. The statute gives no comparative negligence to a claimant who intentionally, wilfully or wantonly caused or contributed to the injury.
