Tennessee MVA leads: a one-year window and modified comparative fault

Tennessee is a fault-based state. Under Tenn. Code 55-12-139, an officer requests evidence of financial responsibility from a driver charged with a traffic violation or involved in a reportable accident, and an insurance card, binder or declaration page from an insurer authorized in Tennessee counts as that evidence. Injured people claim against the driver who caused the crash; there is no no-fault threshold.

Tenn. Code 28-3-104(a)(1) requires actions for injuries to the person to be commenced within one year after the cause of action accrued. Subsection (a)(2) extends that to two years when criminal charges are brought against a person alleged to have caused or contributed to the injury, the conduct is the subject of a criminal prosecution commenced within one year by a law enforcement officer, district attorney general or grand jury, and the injured person sues the party prosecuted.

For buyers, a one-year window is tight. A Tennessee accident that is already several months old may leave a law firm little time to gather records and negotiate before it must file, so accident age filters on Tennessee campaigns should be short. Whether the other driver was criminally charged, for example with an impaired driving offense, is also a field worth capturing, because it can bring the two-year extension into play.

Tennessee adopted modified comparative fault in McIntyre v. Balentine (1992). The Tennessee Supreme Court held that so long as a plaintiff's negligence remains less than the defendant's negligence the plaintiff may recover, with damages reduced in proportion to the plaintiff's share of the total negligence. A claimant found equally at fault recovers nothing, so liability filters (police report, citations issued, rear-end or not) matter as much as injury detail.

Tennessee home improvement leads: ownership and 1987 housing

The Census Bureau puts Tennessee's owner-occupied housing unit rate at 66.9% for 2020-2024, so about two Tennessee households in three own the home they live in. Homeowner confirmation still screens out renters before a lead reaches a contractor.

Tennessee licensing depends on the size of the job. The Board for Licensing Contractors, in the Department of Commerce and Insurance, requires a contractor license for projects above a project-size threshold set in the statute, and a separate home improvement license for smaller residential remodeling jobs, above a lower threshold, in Bradley, Davidson, Hamilton, Haywood, Knox, Marion, Robertson, Rutherford and Shelby counties (home improvement is defined in T.C.A. 62-6-501). Sales made at the home fall under the Tennessee Home Solicitation Sales Act: T.C.A. 47-18-703 lets the buyer cancel until midnight of the third business day after signing.
