Arizona's post-storm roofing contract statute

Arizona writes its storm rules into the contractor licensing chapter. A.R.S. 32-1158.02 (Arizona Legislature, as of October 2026) applies when a licensed contractor contracts to repair or replace a residential roof damaged directly by a catastrophic storm in an area an insurer has designated, and the buyer lives in the home or plans to.
The section requires these terms in the contract:
- A bold statement that the owner may cancel within 72 hours after the insurer denies the claim.
- A second bold statement that the owner may cancel for any reason within four business days after signing.
- A repair estimate that describes the damage and its location, gives the square footage for roof work, says whether the roof was physically accessed, and says the contractor made no promise of coverage.
- A down payment of no more than half the contract.
Once a claim is submitted, the contractor may not promise or pay the deductible, may not start work until the insurer approves or denies the claim (except work to prevent further loss), and may not act as the owner's adjuster. Arizona's homes are young. In the Census Bureau's table B25034 (ACS 5-year 2020-2024), only 29.3% of units were built before 1980, the second lowest share of the 50 states, while 715,871 units were built from 2000 to 2009. Table B25035 puts the median year built at 1992 for 2020-2024.
