Oklahoma claims are paid from the liability coverage of the driver at fault, not from a no-fault benefit. The Oklahoma Insurance Department FAQs (as of October 2026) say the Department of Public Safety regulates the compulsory insurance laws that require financial responsibility, and they describe comparative negligence as the principle under which each party's negligence is based on its contribution to the accident.

The same department lists uninsured motorist coverage as paying the policyholder, resident family members and occupants for injuries caused by an uninsured or underinsured motorist or a hit-and-run driver. Oklahoma's greater-degree rule and the two-year limit

Oklahoma bars a claimant only when their own share of fault is the larger one.
