Kansas PIP benefits and the treatment threshold for pain and suffering

Kansas fixes the benefit floor in its definitions statute. K.S.A. 40-3103 (2025) sets medical benefits at a limit of not less than $4,500, rehabilitation benefits at not less than $4,500, disability benefits at not less than $900 a month for up to one year, funeral benefits up to $2,000, and substitution benefits up to $25 a day for up to 365 days. K.S.A. 40-3107(f) (2025) puts these benefits in every Kansas auto liability policy.
A claim against the other driver for pain, suffering and other non-pecuniary loss is then limited by K.S.A. 40-3117 (2025). It is allowed only if the injury required medical treatment with a reasonable value of $2,000 or more, or the injury includes permanent disfigurement, a fracture to a weightbearing bone, a compound, comminuted, displaced or compressed fracture, loss of a body member, permanent injury, permanent loss of a bodily function, or death. The statute adds that the amount actually charged is not conclusive of reasonable value.

Kansas filing deadline and the less-than test for fault
Fault in Kansas is compared one way: the claimant must be less negligent than the other side. K.S.A. 60-258a(a) (2025) lets a party recover only if that party's negligence was less than the causal negligence of the party or parties against whom the claim is made, and reduces the award by the party's own share. A claimant found equally at fault does not recover.
K.S.A. 60-513(a)(4) (2025) requires an action for injury to the rights of another, not arising on contract, to be brought within two years.
Buyers therefore set an accident age limit inside the two years and read the liability answers closely, since a tie on fault ends the claim.
Liability minimums written into Kansas policies
The liability floor is in the same statute as the PIP requirement. K.S.A. 40-3107(e) (2025) requires stated limits of not less than $25,000 for bodily injury to or death of one person, $50,000 for two or more people in one accident, and $25,000 for damage to the property of others.

The Kansas Rules of Professional Conduct (KRPC) are adopted as Supreme Court Rule 240, which was renumbered from Rule 226 without amendment effective January 1, 2021. The text is in the Kansas Supreme Court rule book (2026 edition):
- KRPC 7.2, Advertising. Paragraph (c) bars giving anything of value for recommending a lawyer's services, except the reasonable cost of permitted advertising and the usual charges of a not-for-profit lawyer referral service or other legal service organization. Paragraph (b) requires a copy of each advertisement to be kept for two years.
- KRPC 7.3, Solicitation of Clients. It covers in-person, live telephone and real-time electronic solicitation, and paragraph (c) requires the words "Advertising Material" on targeted written, recorded or electronic solicitations.
